COMPETITION REGULATIONS "BECOME A FIRST MODUE POWER USER"

(hereinafter referred to as "Regulations")


  1. GENERAL PROVISIONS


    1. The Regulations define the terms and conditions under which a two-stage competition called "Become a first modue power user" ("Competition") takes place.

    2. The Organizer of the Competition is modue sp. z o.o., with its registered office in Kraśnik, at Szpitalna 11, 23-204 Kraśnik, entered in the register of entrepreneurs of the National Court Register kept by the Lublin-Wschód District Court in Lublin, seated in Świdnik, VI Commercial Department of the National Court Register, under KRS number 0001021595, with NIP number: 7151951406, REGON: 524546957, and share capital: 7,600.00 PLN ("Organizer").

    3. The Competition is conducted by the Organizer.

    4. The aim of the Competition is to promote the Organizer's activities as well as its services and products, in particular the implementation of a research and development project by developing technical designs of electronic equipment models to support working with computer devices.

    5. The Competition Regulations are available on the website: modue.com/regulations-en, The Regulations come into effect on the day they are published on this website, which is April 19, 2023.

    6. The Competition is conducted based on these Regulations.


  2. DEFINITIONS


  1. Regardless of other definitions separately indicated in the Regulations, the following terms mean:

    1. Stage I - means the stage in the Competition, in accordance with points 3.2. and 3.3. of the Regulations;

    2. Stage II - means the stage in the Competition, in accordance with points 3.7. and 3.8. of the Regulations;

    3. Finalist - means a Participant selected by the Competition Commission to receive a Prize, taking into account further provisions of the Regulations.

    4. Competition Commission - means a team of two people appointed by the Organizer to assess whether the Participants of the Competition meet the Conditions and to evaluate the Stage I Task and Stage II Task, in order to select the best Competition Solution, according to the subjective assessment of its members;

    5. Laureate - means the Participant of the Competition, selected from among the Finalists by the Competition Commission, who has provided the best Competition Solution. The Organizer reserves the right that within the scope of this Competition, the Competition Commission will select 3 (in words: three) Laureates, taking into account further provisions of the Regulations, especially regarding the possible limitation of their number or changes in their composition or resignation from the selection;

    6. Prizes - means cash prizes in the Competition for those selected by the Competition Commission within the Competition and meeting the conditions indicated in the Regulations:

      1. Laureates - ranked 1-3 - in the amount of 200 PLN (or its equivalent when to be paid in euros);

      2. Finalists - ranked in the remaining places - in the amount of 100 PLN (or its equivalent when to be paid in euros);

    7. Competition Platform - means the Competition website, located at https://forms.office.com/e/YfBzP14vjP, on which the Stage I Task of the Competition is performed;

    8. Competition Solution - the combined elaboration of the Stage I Task of the Competition and the Stage II Task of the Competition, in accordance with the Organizer's requirements.

    9. Participant - means a natural person to whom the Entry for participation in the Competition applies and who meets the Conditions.

    10. Conditions - means the conditions of participation that a Participant or Entry must meet in order to enter the Competition indicated in points 4.1 and 4.2 of the Regulations.

    11. Stage I Task - means the task on the Competition Platform, which consists of answering all closed questions and at least one open question;

    12. Stage II Task - means the elaboration of answers given in Stage I Task during a conversation with one or more members of the Competition Commission, using Microsoft Teams or Zoom video call systems. With the Participant's consent, the conversation will be recorded (sound and video).

    13. Entry - means the Participant's entry to participate in the Competition by performing the Stage I Task of the Competition during the Entry acceptance period, as specified in point 3.2. of the Regulations, in the manner indicated in the Regulations.


  2. FORM AND DESCRIPTION OF THE COMPETITION


    1. The competition is a two-stage and open event. Participants can be individuals who meet the conditions specified in the Regulations.

    2. The first stage of the competition lasts from April 19, 2023, to June 3, 2023. Tasks for Stage I completed after this deadline will not be considered.

    3. During Stage I, participants solve the Stage I Task, which is assessed by the Competition Committee based on the rules provided in the Regulations. The Stage I Task assessment will be completed by June 5, 2023.

    4. For Stage II, the Competition Committee will qualify 30 (thirty) participants who achieved the best results according to the criteria specified in the Regulations.

    5. After determining the results of Stage I, the participants whose Stage I Task solutions qualified for Stage II will be promptly informed of their eligibility to participate in Stage II and asked to choose a date to complete the Stage II Task. The results and proposed dates for the participant's choice will be provided by the Organizer via email to the participant's email address provided in the application.

    6. If a participant, despite being qualified for Stage II, does not choose a date for the Stage II Task or decides to withdraw from the competition, the Organizer will exclude such a participant from further participation in the competition and may decide to qualify another participant with the highest number of points obtained in the Stage I assessment.

    7. During Stage II, participants solve the Stage II Task.

    8. Stage II of the competition lasts from May 5, 2023, to June 18, 2023.

    9. The Competition Solution (understood as the combined completion of the Stage I Task and Stage II Task) will be assessed by the Competition Committee by June 30, 2023.

    10. The Competition Committee will select the Laureates and Finalists from among the participants who submitted Competition Solutions, presenting the most interesting and best technical and business qualities. The assessment of Competition Solutions will be based on the subjective evaluation of the Competition Committee. The criteria for assessing the Competition Solution and the procedures for their selection will be determined independently by the Competition Committee.

    11. The Organizer will announce the list of Laureates and Finalists by the deadline indicated in point 3.9 above

    - on the website modue.com/winnings-list and inform the Laureates and Finalists of their victory by email to the address provided in the application.


  3. PARTICIPATION IN THE COMPETITION


    1. Any natural person who meets the following conditions can be a Participant in the Competition:

      1. is of legal age;

      2. has full legal capacity;

      3. is not a representative, employee or collaborator on any legal basis other than an employment contract of the Organizer or their close relatives, especially spouses, children, grandchildren, parents, and siblings;

      4. has read and accepted the Regulations of participation in the Competition and the Competition Regulations;

      5. has submitted statements, granted consents, licenses and authorizations described in the Regulations for the purposes of organizing the Competition, especially regarding the sending of correspondence related to the Competition by e-mail to the address provided in the Application form;

      6. by June 3, 2023, at 23:59, has made a correct Application, i.e., provided their name, e-mail address, and completed Stage I Task using the mechanism of the Competition website.

    2. Participation in the Competition is:

      1. free of charge;

      2. voluntary and equivalent to accepting the Regulations;

      3. an obligation of the Participant to comply with the Regulations;

      4. a statement that the Participant meets all the conditions that entitle them to participate in the Competition;

    3. Applications violating the Terms of the Regulations will not participate in the Competition.

    4. By participating in the Competition, the Participant agrees to conduct correspondence in the form of e-mail with the Organizer on all matters related to the course of the Competition. The Organizer reserves the right not to be responsible for the receipt of correspondence by the Participant at the e-mail address provided in the Application form, and from the moment of sending the correspondence to such address, considers it delivered, especially in case of not choosing a date for performing the Stage II Task, and as a result, ceasing participation in the Competition.

    5. The Organizer reserves the right to exclude from participation in the Competition Participants whose actions are contrary to the law, good manners or the Regulations, in particular Participants who:

      1. do not act personally but through third parties;

      2. use different aliases (additional addresses) of the same e-mail account to appear on behalf of/register allegedly different Participants;

      3. use scripts, click bots, or any forms of automation to participate in the Competition;

      4. use multi-accounts, fake accounts, or any other forms to increase their chances of winning;

      5. submit applications containing content that is contrary to the law, good manners, infringes the rights of third parties, or presents or describes situations or events that may pose a threat to the health or life of people or animals;

      6. obtain credible information that they are undertaking actions aimed at dishonestly increasing the chances of winning;

    6. Each Participant can apply for the Competition only once. In case of receiving more than one application for participation in the Competition from the same Participant, the Organizer will consider only the first application.

    7. Incorrect, incomplete, or non-compliant applications with the Regulations will not be considered by the Organizer when resolving the Competition. The Organizer may ask the Participant to complete the application. All correspondence from the Organizer will be sent to the Participant's e-mail address provided in the Application. The Participant should complete any deficiencies and inaccuracies indicated in the aforementioned correspondence within 7 calendar days of the summons.

    8. In case of violation of the Regulations by a person applying for the Competition, especially a Participant, including due to violation of the Terms, failure to provide correct personal and contact data, false statements, withdrawal of consents or authorizations specified in the Regulations, or an objection or request for the deletion of necessary personal data, the Organizer may exclude such person from the Competition at any stage of the Competition, even after its completion. The Organizer will notify the Participant about such exclusion by e-mail sent to the address provided in the Application. Until the moment of sending such a message by the Organizer, the Participant takes part in the Competition.

    9. By participating in the Competition, the Participant agrees, in case they become a Laureate or a Finalist, to have their name and e-mail address published in the manner indicated in point 3.11. above. In addition, from the moment of submitting the Application, the Participant grants the Organizer a free-of-charge, non-exclusive, and territory-unlimited license to use the Competition Solution for the purpose of conducting the Competition and promoting the Organizer's activities and its services and products for a period of 3 (three) years, in whole and in parts, on the fields of exploitation listed in Art. 50 of the Act on Copyright and Related Rights of February 4, 1994 (Journal of Laws No. 24, item 83, as amended) and to use them in all forms of advertising the Organizer's activities.


  4. PRIZES


    1. The Laureate and Finalist of the Competition will receive Prizes specified in the Regulations. The Prize can be paid out in the currency: Polish zloty or euro.

    2. Participants submitting Applications confirm that they are aware that in case of winning a Prize, in order to receive it, they will be obliged to provide the Organizer with a bank account number to which the Prize is to be paid.

    3. The Laureate and Finalist have 10 (ten) days from the date of the announcement of the list of Laureates and Finalists by the Organizer to send a reply to the Organizer, with all the necessary data needed for the realization/transfer of the Prizes, which will be detailed in the content of the Organizer's message.

    4. In case the Laureate or Finalist does not fulfil the requirements for receiving the Prizes in the manner and within the deadline specified in point 5.3. above, the Organizer is entitled, at its own discretion, to exclude the respective Laureate or Finalist from the Competition, change the "order" of Laureates and Finalists in terms of the Prizes awarded to them, and to ask the Competition Commission to indicate the next Competition Solutions in order to complete the list of Laureates and Finalists. Such supplementary selection and announcement of additional Laureates and Finalists will take place no later than June 30, 2023.

    5. The Prizes, subject to points 5.3. and 5.4., will be paid out within a period of no less than 15 days and no longer than 30 days from the announcement of the list of Laureates and Finalists, and in case of submitting a complaint, within a period not exceeding 30 days after the date of the final decision issuance.

  5. COMPLAINTS


    1. Each Participant has the right to file a complaint in case of any irregularities in the scope of the organized Competition in relation to the provisions of the Regulations ("Complaint"). The complaint should be submitted to the Organizer immediately after the occurrence of circumstances that raise the Participant's objections, however, no later than within 7 days from the day of learning about the event justifying the filing of the Complaint.

    2. The Participant can file a Complaint:

      1. in writing, at the Organizer's headquarters or by postal mail to the address indicated in point 1.2. above;

        and

      2. by electronic mail to the address: competition@modue.com.

      3. In the complaint submission, the Participant should provide: first name, e-mail address, reasons, and justification for the Complaint, as well as the Participant's request.

      4. The right to file a Complaint is granted only to Participants.

      5. The consideration of Complaints takes 14 (fourteen) days from the day of its receipt. The Organizer, while considering the Complaint, will apply the provisions of the Regulations. The Participant will be notified of the decision by e-mail to the address provided in the Complaint.

      6. In case the information provided by the Participant is not sufficient to consider the Complaint, the Organizer will immediately, upon submission of such incomplete information in the Complaint, request the Participant to complete it.


  6. INFORMATION ON PERSONAL DATA PROCESSING


    1. The personal data of the Competition Participants will be processed by the Organizer for the purpose of performing activities necessary for the proper conduct of the Competition, and if the Participant gives consent, also for marketing purposes.

    2. The personal data administrator ("Administrator") of the Participants is MODUE SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ with its registered office in Kraśnik, at the address: ul. Szpitalna 11, 23-204 Kraśnik, Poland, entered into the Register of Entrepreneurs of the National Court Register, kept by the Lublin East District Court in Lublin with its seat in Świdnik, VI Commercial Division of the National Court Register, under the KRS number: 0001021595, having NIP number: 7151951406, REGON number: 524546957.

    3. If you have any questions regarding the processing of your personal data and your rights, you can contact the Administrator by e-mail at: privacy@modue.com.

    4. The Organizer processes the Participant's personal data:

      1. for the purpose of conducting the Competition, based on explicit consent confirming the Participant's participation in the Competition, i.e., joining the completion of specific Competition tasks, and also for the purpose of awarding the Prize, based on the legitimate interest, which is the conduct of the Competition (Article 6(1)(f) of the GDPR),

      2. for the purpose of obtaining responses to complaints submitted by Competition Participants regarding the complaint procedure, and also for the purpose of making appropriate tax settlements in the event of awarding the Participant a Prize in the Competition, in the performance of a legal obligation (Article 6(1)(c) of the GDPR),

      3. for marketing purposes, based on separate consent (Article 6(1)(a) of the GDPR),

      4. for the realization of the Administrator's legitimate interest based on Article 6(1)(f) of the GDPR, which consists of:

        1. pursuing or defending against claims,

        2. communication for the purposes related to the conduct of the Competition,

        3. recording and disseminating responses in accordance with the Regulations.


    5. The personal data referred to in point 4 above will be processed until the expiry of the limitation period for claims, including tax claims related to the contract - but no longer than 6 years. To the extent that the data is processed on the basis of consent or legitimate interest, it will be processed until the consent is withdrawn or the objection is considered - but no longer than 6 years.

    6. The recipients of personal data may be:

      1. Microsoft system providers for online surveys (https://privacy.microsoft.com/pl-pl/privacystatement, https://support.microsoft.com/en-us/office/security-and-privacy-in-microsoft-forms-7e57f9ba-4aeb-4b1b-9e21-b75318532cd9);

      2. Microsoft Teams and Zoom videoconferencing systems; https://learn.microsoft.com/en-us/microsoftteams/teams-privacy, https://explore.zoom.us/en/privacy/;

      3. MS Office 365 database systems, https://privacy.microsoft.com/pl-pl/privacystatement, ,

      4. sendinblue mailing system, https://www.sendinblue.com/legal/privacypolicy;

      5. service providers acting on behalf of the Organizer, for the purpose of performing activities necessary for the proper conduct of the Competition or for marketing purposes;

      6. IT service providers responsible for the maintenance of IT systems (including email hosting), postal operators, couriers, banks, marketing agencies (within the scope of marketing services), the Organizer's collaborators, including subcontractors, entities providing legal services for the Administrator;

      7. tax authorities, the National Center for Research and Development under the Support Agreement dated March 17, 2023, or other entities authorized to control the Administrator.

    7. Personal data will not be profiled. Personal data, except for the cases indicated in point 6 above, will not be transferred outside the EEA. Providing personal data is voluntary, but in the scope of joining the Competition, it is necessary to participate in the Competition.

    8. The Competition Participant has the right to:

      1. access their data and correct, rectify, delete, restrict, share, transfer, and object to their processing;

      2. withdraw consent to the processing of personal data at any time, with the withdrawal of consent not affecting the legality of processing carried out based on consent before its withdrawal;

      3. request the Organizer to delete their personal data;

      4. file a complaint with the supervisory authority dealing with personal data protection if it is considered that the processing of personal data violates the GDPR. Each data subject also has the right to lodge a complaint with the supervisory authority in the country where the data subject resides, in Poland: President of the Personal Data Protection Office (PUODO), ul. Stawki 2, 00-193 Warsaw, telephone: 22 860 70 86;

      5. object to the processing of data in a situation where the basis for the processing of personal data is the legitimate interest of the Administrator.

    9. Deleting, modifying, or objecting to the processing of their data by the User is possible by sending an email to: privacy@modue.com.

  7. ELECTRONIC SERVICES PROVIDER


    1. This Regulations also constitutes the regulations for providing electronic services within the meaning of Article 8 of the Act of July 18, 2002, on the provision of electronic services. The services provided electronically by the Organizer are free of charge and provided exclusively to the extent necessary to organize and conduct the Competition.

    2. In connection with the Competition, the Organizer provides the following electronic services:

      1. The Competition Platform, enabling Participants to submit Applications and complete Stage I Task;

      2. Information services consisting of informing about the Competition.

    3. To use the electronic services provided by the Organizer, particularly to apply for the Competition, it is necessary to meet the following technical requirements: having access to the Internet and a device that allows entry to the Competition website.

    4. The conclusion of the agreement for the provision of electronic services takes place when submitting the Application via the Competition Platform, while its termination occurs at the end of the Competition. At any time, the Participant is entitled to terminate their participation in the Competition by submitting a resignation, which is equivalent to the termination of the provision of electronic services by the Organizer in this respect. Participation in the Competition is voluntary; however, submitting a resignation is equivalent to the lack of possibility to participate further.

    5. The Participant is prohibited from providing unlawful content.

    6. The provisions of point 7 above shall apply accordingly to complaints about services provided electronically.


  8. FINAL PROVISIONS


  1. This Competition is not a random game, a phantom lottery, a mutual bet, a promotional lottery, a game whose outcome depends on chance, or any other form provided for in the Act of July 29, 1992, on games of chance and mutual bets (Journal of Laws No. 68, item 341, as amended).

  2. The Organizer reserves the right to change these Regulations at any time without giving any reason if it does not affect the acquired rights of the Participants, and in the scope of changing the dates of actions within the Competition, there is such a necessity resulting from reasons independent of the Organizer, provided that these restrictions on changes do not affect the necessary changes in cases of force majeure. The change of the Regulations comes into force after its announcement on the Organizer's website (specified above).

  3. The court competent to resolve disputes related to the execution and implementation of the Competition is the locally competent court, determined in accordance with the provisions of the Code of Civil Procedure, resulting from general jurisdiction.

  4. If a competent court decides that any provision of these Regulations is invalid or ineffective, the remaining provisions of the Regulations shall remain valid and effective.
